These terms of use (the "Terms") govern access to and use of the Manger.ma platform (website and application), which connects merchants with unsold food (the "Partners") and customers wishing to buy it at a reduced price (the "Customers"). By creating an account or using the platform, you accept these Terms without reservation.

1. Description of the service

Manger.ma is an online marketplace fighting food waste in Morocco. Partners publish "surprise baskets" made up of their unsold items of the day, offered at a reduced price. Customers reserve a basket online for free, then collect it and pay for it directly in store during the indicated pickup window.

Manger.ma acts exclusively as a technical intermediary: the sale is concluded directly between the Customer and the Partner at the time of pickup and in-store payment. Manger.ma is neither the seller, nor the producer, nor the holder of the products offered.

2. Accounts and registration

Using the service requires creating an account with a valid email address, which must be verified. You undertake to provide accurate, up-to-date information, keep your password confidential and not create an account for someone else without authorisation. You are responsible for all activity carried out from your account.

Registration is reserved for people aged 18 or over, or with the authorisation of a legal guardian. Manger.ma reserves the right to suspend or delete an account in the event of a breach of these Terms, fraud or manifest abuse.

3. Reservations, pickup and payment

Reserving a basket on the platform is free and involves no online payment. A reservation is a commitment to come and collect the basket during the indicated pickup window and to pay the displayed price directly to the Partner, in store.

A 6-digit pickup code is assigned to each order; it must be shown to the Partner at pickup. By nature, the exact contents of a surprise basket are not known in advance: only the product category, the indicative original value and the reduced price are guaranteed.

4. Cancellation and no-show

The Customer may cancel a reservation from their personal area as long as the order is awaiting confirmation by the Partner. Once the order has been confirmed, cancellation is no longer possible through the platform; the Customer should contact the Partner or support.

A Customer who does not show up during the pickup window without cancelling forfeits the basket, which the Partner may put back on sale or dispose of. Repeated no-shows without cancellation constitute misuse of the service and may lead to account suspension.

5. Partner obligations

The Partner warrants that it operates its business lawfully and holds all required authorisations. It undertakes to offer only products fit for consumption at the time of pickup, and to comply with the cold chain and applicable Moroccan regulations on hygiene and food safety.

Responsibility for the quality, conformity and food safety of the products sold lies exclusively with the Partner, in its capacity as professional seller. The Partner also undertakes to honour confirmed orders, respect announced pickup windows and describe its baskets fairly.

6. Prices

Basket prices are set freely by each Partner and displayed in Moroccan dirhams (MAD), all taxes included. The price paid by the Customer is the one displayed at the time of reservation. The original value shown for a basket is an estimate provided by the Partner for information purposes.

7. Intellectual property

The platform, its visual identity, texts, logos and software components are protected by intellectual property law and remain the exclusive property of Manger.ma or its licensors. Any unauthorised reproduction or exploitation is prohibited. Partners grant Manger.ma a licence to use the content they publish (names, photos, descriptions) solely for the operation and promotion of the service.

8. Liability

Manger.ma uses reasonable means to ensure the availability and security of the platform, without guaranteeing uninterrupted operation. Manger.ma is not liable for the products sold by Partners, their quality, or damage resulting from their consumption, as the sale is concluded directly between the Customer and the Partner.

In any event, Manger.ma's liability shall not exceed the amount paid by the Customer for the order giving rise to the damage, except where mandatory legal provisions state otherwise. Nothing in these Terms excludes liability that cannot be limited under Moroccan law.

9. Personal data

The processing of users' personal data is described in our Privacy Policy, drawn up in accordance with Law No. 09-08 on the protection of individuals with regard to the processing of personal data.

10. Changes to the Terms

Manger.ma may amend these Terms at any time, in particular to reflect legal or functional developments. Users will be informed of substantial changes by any appropriate means (email or notification on the platform). Continued use of the service after the new Terms take effect constitutes acceptance.

11. Applicable law and jurisdiction

These Terms are governed by Moroccan law. Failing amicable resolution of a dispute relating to their interpretation or performance, exclusive jurisdiction is granted to the courts of Casablanca, subject to mandatory jurisdiction rules applicable to consumers.
